Can the 9927 exit device be installed Less Top Rod?

The top rod is required for proper operation.  The top latch controls both the top & bottom rods and without the top latch/rod the bottom latch would release when pushpad or trim was used but then drop and drag on floor once released. This would cause the door to not relatch and create an arc in the floor from latch dragging preventing the devices from working without the top rod/latch.
