This problem will be exhibited out of the box. The outside springcage and driver may bind causing the lever to stay in the down (or up) position. This issue does not affect the inside lever. Replace the outside springcage and driver as needed.
This issue was resolved on October 15th, 2012. Unknown at this time how long this potential condition has existed.
